The Terms of Use listed below govern use of the online services (the “Online Services”) and materials available therein (“Materials”) provided by Analytical Biosciences Limited and its affiliated companies (collectively “we”, “us”, or “our”).

By using our website or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and you acknowledge that all information you provide to us is governed by our Privacy Policy. If you do not want to agree to these Terms of Use or the actions we take with respect to your information consistent with our Privacy Policy, please do not access or use our website.

The Electronic Products and the Intellectual Property Rights contained therein are protected by law. As a User, you have rights specified below; all other rights are reserved.

Definitions

  1. 1. Electronic Products: All products, services, and contents available in OmniBrowser.
  2. 2. Intellectual Property Rights: These rights include, without limitation, patents, trademarks, trade names, design rights, copyright (including rights in computer software), database rights, rights in know-how and other intellectual property rights, in each case whether registered or unregistered, which may subsist anywhere in the world.
  3. 3. OmniBrowser: The online service (or any successor thereto) available from Analytical Biosciences Limited or its affiliates including all products, services and features offered via [omnibrowser.abiosciences.com].
  4. 4. Users: Authorized users of OmniBrowser.

Rules of Use

  1. A. To make OmniBrowser and the Electronic Products useful, the following rules apply:
    1. 1. All users may browse permitted Tables of Content for all Electronic Products on OmniBrowser, and search the permitted database of Tables of Content and abstracts.
    2. 2. Users may search, display and view articles or items for their own personal use, scholarly use, educational or scientific research use and internal business use. Users may also download certain figures and images.
    3. 3. Except as provided above or with respect to materials published on an open access basis, Users may not download, copy, distribute, transmit or otherwise reproduce, sell or resell material from Electronic Product(s); store such material in any form or medium in a retrieval system; download and/or store an entire issue of an Electronic Product or its equivalent; or transmit such material, directly or indirectly, for use in any paid service such as document delivery or list serve, or for use by any information brokerage or for systematic distribution, whether or not for commercial or non-profit use or for a fee or free of charge.
    4. 4. We provide a 15 days free trial account to users. Trial account users may search, display and view articles or items for their own personal use, scholarly, educational or scientific research use. Trail account users may not use the account or any Material for any commercial purpose.
  2. B. Users agree not to remove, obscure or modify any copyright or proprietary notices, author attribution or any disclaimer as they appear on OmniBrowser. Users may not integrate materials from the Electronic Product(s) with other materials or otherwise create derivative works in any medium or override any security feature or exclusionary protocol. However, brief quotations for purposes of comment, criticism or similar scholarly purposes are not prohibited herein.
  3. C. Users may not do anything to restrict or inhibit any other User's access to or use of OmniBrowser and the Electronic Product(s).
  4. D. If a User refuses or fails to abide by these Terms of Use or violates any other terms of this Agreement, we reserve the right in its sole discretion to suspend or terminate their access to OmniBrowser and the Electronic Products immediately without notice, in addition to any other available remedies.
  5. E. Users shall not have the right to incorporate any materials from the Electronic Products into any institutional or other repository under any circumstances without our prior written approval (including social networking websites and scholarly collaboration networks).
  6. F. Users agree not to conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent.

Additional Terms

  1. A. OmniBrowser is not responsible for any charges associated with accessing OmniBrowser and the Electronic Products, including, but not limited to, any computer equipment, telephone or internet connections and access software.
  2. B. OmniBrowser may modify any of these terms and conditions at any time by providing notice on our website. A User’s continued use of OmniBrowser shall be conclusively deemed acceptance of such modification.
  3. C. OmniBrowser may provide links to third-party websites. Where such links exist, we disclaim all responsibility and liability for the content of such third-party websites. Users assume the sole responsibility for the accessing of third-party websites and the use of any content appearing on such websites.

Governing Law

This Agreement shall be governed and construed exclusively in accordance with the laws of the Hong Kong Special Administrative Region of the PRC (“Hong Kong”), without regard to principles of its conflicts of laws thereunder.

Privacy and Data Protection Policy

OmniBrowser recognizes the importance of protecting the information it collects in the operation of OmniBrowser and will act in compliance with the Privacy Policy.

Warranty Limitations

OMNIBROWSER AND THE ELECTRONIC PRODUCTS AND ALL MATERIALS CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; THE USE OF THE ELECTRONIC PRODUCTS, OMNIBROWSER AND ALL MATERIALS ARE AT THE USER'S OWN RISK; ACCESS TO OMNIBROWSER AND THE ELECTRONIC PRODUCTS MAY BE INTERRUPTED AND MAY NOT BE ERROR FREE; AND NEITHER OMNIBROWSER NOR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE ELECTRONIC PRODUCTS OR THE MATERIALS CONTAINED IN OMNIBROWSER, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USER'S USE OF OR INABILITY TO USE OMNI BROWSER, THE ELECTRONIC PRODUCTS AND ALL MATERIALS CONTAINED THEREIN.
